1. Using the App
- passEE, passMCQ and passPVUE is intended for users aged 13 or older
- The app is provided "as is" without guarantees of uninterrupted service or error-free operation
2. Accounts and Authentication
- You are responsible for keeping your account credentials secure
- On Android, only Google Sign-In is supported. On iOS, Google, Apple, and email authentication are supported for login.
- You may request deletion of your account and associated data at any time by contacting support@npd-pass.com
3. Payments and Subscriptions
- Payments for subscriptions and in-app purchases are handled securely by third-party processors
- Refunds are subject to the terms of the App Store, Google Play, or our payment provider
4. Prohibited Activities
You agree not to:
- Reverse engineer, decompile, or tamper with the app
- Use the app for illegal or harmful purposes
- Access other users' accounts or data without authorization
- Content Extraction: Capture, extract, copy, or reproduce any content from the app through any means, including but not limited to:
- Taking screenshots or screen recordings of questions, answers, explanations, or any other app content
- Using optical character recognition (OCR) tools or image-to-text conversion services
- Using artificial intelligence (AI) tools, automated scripts, or bots to extract content
- Manually transcribing, typing, or copying questions, answers, or explanations
- Using any third-party software, browser extensions, or tools designed to extract or capture app content
- Derivative Works: Create, compile, or distribute any derivative works based on app content, including but not limited to:
- Question banks or study materials derived from app content
- Databases, spreadsheets, or collections of questions or answers
- Any compilation or aggregation of app content in any format
- Account Sharing: Share your account credentials or allow others to access your account
- Device Restrictions: Violate the device switching policy or attempt to circumvent device limitations (see Device Switching Policy section)
5. Intellectual Property
- All content, trademarks, and features in the app are owned by passEE, passMCQ and passPVUE or its licensors
- You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the app for personal, non-commercial purposes only
- This license is strictly limited to a single user per account and is subject to device restrictions as outlined in the Device Switching Policy
- You may not reproduce, distribute, extract, copy, modify, create derivative works from, or otherwise exploit any app materials, content, questions, answers, explanations, or features without prior written consent
- Any unauthorized extraction, reproduction, or distribution of app content constitutes a violation of these terms and may result in immediate termination of your account and legal action
- All questions, answers, explanations, and educational content are proprietary intellectual property protected by copyright and other applicable laws
6. Device Restrictions and Single-User License
- Your subscription is granted for use by a single individual only
- Account sharing, multiple concurrent users, or unauthorized access is strictly prohibited
- Device switching is subject to the Device Switching Policy, which includes progressive cooldown periods and limitations on the number of concurrent active devices
- We reserve the right to monitor device usage, account activity, and behavioral patterns to detect violations of these terms
- Excessive device switching, suspicious activity patterns, or attempts to circumvent device restrictions may result in immediate account termination without refund
7. Monitoring and Enforcement
- We actively monitor app usage, user behavior, and account activity to detect violations of these terms, including but not limited to:
- Content extraction attempts (screenshots, OCR usage, automated tools)
- Unauthorized account sharing or device switching abuse
- Suspicious activity patterns or usage anomalies
- We maintain audit logs, usage analytics, and behavioral data to support enforcement actions
- By using the app, you consent to such monitoring and acknowledge that evidence of violations may be used in enforcement proceedings
- We reserve the right to investigate any suspected violations and may request additional information or documentation from users
8. Termination of Access and Remedies
We reserve the right to terminate or suspend accounts immediately, without prior notice, for violations of these terms, including but not limited to:
- Content extraction, screenshotting, or unauthorized reproduction of app materials
- Creation or distribution of derivative works based on app content
- Account sharing or unauthorized device usage
- Any other violation of these Terms of Service
Remedies and Penalties:
- No Refund Policy: Upon termination for violation of these terms, you are not entitled to any refund of subscription fees, regardless of the remaining subscription period
- Retroactive Invalidation: We reserve the right to retroactively invalidate your access and deny refunds for the entire subscription period if violations are discovered
- Content Takedown: If you have created derivative works or distributed app content, you must immediately cease such activities and remove all such content from any platforms, databases, or storage systems. We may demand takedown of such content and pursue legal remedies if you fail to comply
- Legal Action: We reserve the right to pursue all available legal remedies, including but not limited to injunctive relief, damages, and recovery of legal costs and attorney fees
- Reporting: We may report violations to relevant authorities, app stores, or third-party platforms as appropriate
9. Limitation of Liability
passEE, passMCQ and passPVUE are not liable for indirect, incidental, or consequential damages resulting from your use of the app.
10. Updates to the Terms
We may update these terms to reflect changes in our app or legal requirements. Material changes will be communicated through the app or via email. Continued use of the app after such updates constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must discontinue use of the app immediately. Your continued use after the effective date of any updates indicates your agreement to be bound by the modified terms.
Device Switching Policy
Device Switch Cooldown System
Our app implements a progressive cooldown system for device switches to maintain security and prevent abuse:
- First Switch: Immediate (no cooldown)
- Second Switch: 1 hour cooldown
- Third Switch: 3 hours cooldown
- Fourth Switch: 24 hours cooldown
- Fifth Switch: 3 days cooldown
- Sixth Switch: 7 days cooldown
- Seventh Switch and beyond: 14 days cooldown
Important Notes:
- Maximum of 1 concurrent active devices per account
- Device switches are tracked and logged for security
- Unauthorized devices will be automatically signed out
- Cooldown periods are strictly enforced and cannot be bypassed
- The cooldown timer starts when a device switch is initiated
- Users can view their remaining cooldown time in the settings
This policy helps us:
- Protect user data and privacy
- Prevent unauthorized account sharing
- Maintain service quality
- Ensure fair usage of the platform
